Education in Ireland Contest

Description: Internet access required to enter. Personal Facebook account required to win. The “Education in Ireland Contest” (the “Contest”) begins on Monday, February 19th, 2018 and ends on Friday, March 23rd at 9:59:59 am Eastern Time (“ET”)(“Contest Period”). The sponsor of this Contest is Teachers Council, Inc., 77 West Street, Suite 210, Annapolis, MD 21401 (“Sponsor”).
Eligibility: Contest is open only to United States citizens who are physically located and residing in the fifty (50) United States and Washington, D.C. (each a “Contestant” and collectively “Contestants”). Contestants must be at least twenty-one (21) years of age at the time of entry. Contestants must be the rightful owner (or have authorized use) of the email address identified on the Contest form. Contestants must be currently employed as a teacher or school administrator in a primary or secondary school for the education of children in the United States at the time of entry. Employees, owners, shareholders, officers and directors of Sponsor (collectively, the “Contest Entities”), and each of their respective parent companies, affiliates, divisions, subsidiaries, agents, representatives, promotion and advertising agencies together with the immediate family members and/or those living in the same household of such persons (collectively, “Household Members”), are not eligible to participate in the Contest. For purposes of the Contest “Household Members” shall mean those people who share the same residence at least three months a year; “Immediate Family Members” shall mean parents, step-parents, legal guardians, children, step-children, siblings, step-siblings, or spouses. In the event of a dispute over the identity of a Contestant or potential winner in the Contest, the Contestant or potential winner will be deemed the authorized account holder of the email address associated with the entry. “Authorized Account Holder” is defined as the natural person in whose name the e-mail account was opened. In the event a dispute regarding the identity of an Contestant or potential winner cannot be resolved to Sponsor’s satisfaction, the affected entry will be deemed ineligible. Entries will not be acknowledged except as provided herein. Contest Grand Prize is non-transferable and cannot be substituted, sold or bartered. Void where prohibited or restricted by law.
Agreement to Rules: By participating, the Contestant agrees to be fully unconditionally bound by these Rules, and Contestant represents and warrant that Contestant meets the eligibility requirements. In addition, Contestant agrees to accept the decisions of Sponsor as final and binding as it relates to the content of this Contest.
How to Enter:Eligible Contestants may enter the Contest by visiting https://TeachersCouncil.com/Contest (the “Contest Homepage”) and following the on-screen instructions to access the Contest form. Contestant must provide all of the information requested on the Contest form, including but not limited to Contestant’s full name, physical address and email address, a photograph, and a descriptive narrative of up to 400 words, then click “Submit” to receive one (1) entry into the Contest. Limit of one (1) entry per person during the Contest Period. If entries exceed one (1) per person during the Contest Period, the Contestant may be disqualified, at the Sponsor’s sole discretion. Contestants may not enter more times than indicated by using multiple email addresses, identities, or devices in an attempt to circumvent the Official Rules. Entries generated by a script, macro or other automated means will be disqualified. Incomplete, unreadable, or unintelligible entries will be disqualified. All information provided by Contestants becomes the property of Sponsor. Participation in the Contest constitutes Contestant’s understanding of, full and unconditional agreement to, and acceptance of these Official Rules. Sponsor reserves the right to disqualify any Contestant that Sponsor determines to be in violation of any term contained in these Official Rules. Sponsor’s decision not to enforce a specific provision of these Official Rules does not constitute a waiver of that provision of the Official Rules generally. Sponsor has the right to change the Contest Period, and all other dates or deadlines set in connection with this Contest, at any time and in its sole discretion.
Odds: The odds of winning depend on the number of eligible entries received.
Grand Prize: There is one (1) Grand Prize available (one (1) consisting of Sponsor’s scholarship of the Winner for the National University of Ireland (“NUI”), Galway’s Education in Ireland International Summer School Program in Galway, Ireland (The “Program”). The Program includes:
Approximate retail value (“ARV”) of Program is USD $3,560.00 (based on current Euro to USD conversion rates, may vary slightly depending on current conversion rate at the time of enrollment into the Program). Round trip flights to and from Ireland are not included in the Grand Prize and are the responsibility of the Winner. No cash or other prize substitution shall be permitted. The prize is non transferable. Any and all prize-related expenses, including without limitation any and all federal, state, and/or local taxes, transportation, meals, souvenirs, tips, entertainment, shall be the sole responsibility of Winner. No substitution of prize or transfer/assignment of prize to others or request for the cash equivalent by Winner is permitted. Acceptance of prize constitutes permission for Sponsor to use Winner’s name, likeness, and entry for purposes of advertising and trade without further compensation, unless prohibited by law. If the Winner is unable or unwilling to accept the Grand Prize, or any portion thereof, as stated, the Grand Prize may be forfeited in its entirety at the sole discretion of Sponsor. Winner agrees that he or she undertakes the Program at their own risk. Sponsor is not responsible for any outcomes, delays, credits, or content of the Program.
Winner Selection and Notification: On Monday, March 12th, six (6) semi-finalist Contestants will be selected by Sponsor in its sole discretion, based on the contents of the Contest form submitted via the Contest Homepage, from all Contest forms submitted by the deadline of 11:59:59 pm ET on Sunday, March 11th. The semi-finalist Contestants will be notified via the email address provided on the registration form. The semi-finalist Contestants are responsible for checking their spam filter. The semi-finalists will be required to respond (as directed) to the notification within (5) days (or a shorter time if required by exigencies) of attempted notification. The failure to respond within the stated time period may result in the forfeiture of the ability to continue in the final phase of the contest for the Grand Prize. The semi-finalist Contestants will be required to confirm his or her intent to continue onward to the final phase of the contest for the Grand Prize, to confirm his or her intent to accept the Grand Prize in its entirety, and agree to create a post-trip report to the Sponsor consisting of photographs and written narrative of the trip upon Program completion, if selected the Grand Prize winner. On or about Monday, March 12th, Sponsor will post the photo and biographical story of the six (6) semi-finalist Contestants who have confirmed their intent to the Sponsor to move on to the final phase of the contest, and their intent to accept the Grand Prize, if selected the winner, to Sponsor’s Facebook page https://www.facebook.com/TeachCouncilUSA/ in a Contest photo album, initiating the final phase of the Contest. From the time that the semi-finalist Contestant photos are posted to the Sponsor’s Facebook Contest photo album, semi-finalist contestants will compete to obtain the most “Likes” on his or her photo in the album by the deadline of 9:59:59 am ET on Friday, March 23rd. Semi-finalist contestants may share the photo to friends, family, and colleagues via the internet and social media channels in order to encourage “Likes” on the photo. Semi-finalist contestants who are found to have made fictitious, robotic, or duplicate Facebook profiles, or to have paid users in exchange for “Likes”, will be disqualified. On or about Friday, March 23rd, one (1) potential Grand Prize winner will be selected based upon the photo and narrative within the Sponsor’s Facebook Contest photo album from the six (6) semi-finalist entries, based on the photo and narrative that obtained the highest total number of “Likes” by the Contest end of 9:59:59 am on Friday, March 23rd. The potential winner will be notified via the email address provided on the registration form. The potential winner is responsible for checking his/her spam filter. The potential winner will be required to respond (as directed) to the notification within five (5) days (or a shorter time if required by exigencies) of attempted notification. The failure to respond within the stated time period may result in the forfeiture of the Grand Prize. The potential winner will be required to verify address, sign, and return within five (5) days of initial notification one or more declaration forms covering eligibility, liability, advertising and (unless prohibited by law) publicity rights and such other documents as Sponsor may provide (collectively, “Prize Acceptance Forms”). Failure of a winner to return the Prize Acceptance Forms within the specified time period may result in the forfeiture of the Grand Prize and selection of an alternate potential winner from the remaining semi-finalists, selecting from the next-highest number of “Likes” on his or her photo obtained by the deadline, and so on. Sponsor, in its sole discretion will attempt to contact up to three (3) potential winners of the Grand Prize in accordance with the above procedure, after which the Grand Prize in question may go unawarded if it remains unclaimed. The winner must provide Sponsor with a valid social security number for tax reporting purposes. The winner will receive an IRS Form 1099 from the Sponsor for the actual retail value of the Grand Prize for the calendar year in which the Grand Prize was fulfilled. Receipt by Winner of the Grand Prize is conditioned upon compliance with any and all federal, state, and local laws and regulations.
Rights Granted by Contestant: By entering this Contest, Contestant understands and agrees that the Sponsor, anyone acting on behalf of the Sponsor, and the Sponsor’s licensees, successors, and assigns, shall have the right, where permitted by law, to print, publish, broadcast, distribute, and use in any media now known or hereafter developed, in perpetuity and throughout the World, without limitation, your entry, name, portrait, picture, voice, likeness, image, statements about the Contest, and biographical information for news, publicity, information, trade, advertising, public relations, and promotional purposes without any further compensation, notice, review, or consent. By entering this Contest, Contestant represents and warrants that Contestant’s entry is an original work of authorship, and does not violate any third party’s proprietary or intellectual property rights. If Contestant’s entry infringes upon the intellectual property right of another, Contestant will be disqualified at the sole discretion of Sponsor. If the content of Contestant’s entry is claimed to constitute infringement of any proprietary or intellectual proprietary rights of any third party, Contestant shall, at Contestant’s sole expense, defend or settle against such claims. Contestant shall indemnify, defend, and hold harmless Sponsor from and against any suit, proceeding, claims, liability, loss, damage, costs or expense, which Sponsor may incur, suffer, or be required to pay arising out of such infringement or suspected infringement of any third party’s right.
Terms & Conditions: Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Contest should virus, bug, non-authorized human intervention, fraud, or other cause beyond Sponsor’s control corrupt or affect the administration, security, fairness, or proper conduct of the Contest. In such case, Sponsor may select the Winner from all eligible entries received prior to and/or after (if appropriate) the action taken by Sponsor. Sponsor reserves the right, in its sole discretion, to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Contest or Sponsor website or violates these Terms & Conditions. Sponsor has the right, in its sole discretion, to maintain the integrity of the Contest, to void votes for any reason, including, but not limited to: multiple entries from the same user from different IP addresses; multiple entries from the same computer in excess of that allowed by Contest rules; or the use of bots, macros, scripts, or other technical means for entering. Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of the Contest may be a violation of criminal and civil laws. Should such attempt be made, Sponsor reserves the right to seek damages to the fullest extent permitted by law.
Limitation of Liability: By entering, Contestant agrees to release and hold harmless Sponsor and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from: (i) such entrant’s participation in the Contest and/or Program and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof; (ii) technical failures of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (iii) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (iv) unauthorized human intervention in any part of the entry process; (v) electronic or human error in the administration of the Contest or the processing of entries.
Disputes: THIS CONTEST IS GOVERNED BY THE LAWS OF THE UNITED STATES OF AMERICA AND THE STATE OF MARYLAND, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this Contest, Contestant agrees that any and all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with this Contest, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Maryland having jurisdiction. Further, in any such dispute, under no circumstances shall participant be permitted to obtain awards for, and hereby waives all rights to, punitive, incidental, or consequential damages, including reasonable attorney’s fees, other than participant’s actual out-of-pocket expenses (i.e. costs associated with entering this Contest). Contestant further waives all rights to have damages multiplied or increased.
Facebook: The Contest hosted by Sponsor is in no way sponsored, endorsed, administered by, or associated with Facebook.
